5. Payment and Refunds
All payments for services are due as agreed upon in the invoice or service agreement. Refunds may be granted only under the following conditions:
- If the project has not yet started
- If the Company is unable to deliver the agreed-upon service
- Any refund request must be made in writing within 7 calendar days of payment
Custom work (e.g., writing, editing, or design) that has been started or completed is non-refundable.
6. Claims for Defects
Claims for defects, damages, or shortages must be made by the customer in writing no later than 07 calendar days after delivery. If no such claim is made, Nexell Book Writing and the customer will understand that the job has been accepted. By accepting the job, the customer acknowledges that Nexell Book Writing's performance has fully satisfied all terms, conditions, and specifications. Nexell Book Writing's liability will be limited to the quoted printing and binding price of defective goods without additional charge for special or consequential damages. As security for payment of any sum due under the terms of an agreement, Nexell Book Writing has the right to hold and place a lien on all customer property in Nexell Book Writing's possession. This right applies even if credit has been extended, notes have been accepted, trade acceptances have been made, or payment has been guaranteed. If payment is not made, the customer is liable for all collection costs incurred.
7. Limitation of Liability
Nexell Book Writing is not liable for:
- Any indirect, incidental, or consequential damages
- Delays caused by factors outside our control
- Client dissatisfaction arising from vague or incomplete project instructions
Our total liability for any claim related to the services shall not exceed the amount paid by the client for those services.
8. Confidentiality
We respect your privacy and treat all client content and communications as confidential. We will not disclose your materials to third parties except:
- As necessary to deliver the services (e.g., freelance writers under NDA)
- When required by law
